The Locker – Terms of Service
The Locker is operated and managed by the University of Southampton Student’s Union, a registered charity and company limited by guarantee in England & Wales (Company no. 80343710, registered address Building 42, University Road, Southampton, Hampshire, SO17 1BJ).
The terms “we”, “us” and “our” refer to The Locker, which operates our physical and online store, including all related information, content, products and services to provide you, the customer, with a curated shopping experience (the “Services”). The Locker online store is powered by Shopify.
These terms and conditions describe your rights and responsibilities when you use the Services. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. Your continued use of or access to the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
These Terms and Conditions, and the relationship between you and Us (whether contractual or otherwise) shall be governed by and construed in accordance with the law of England & Wales.
SECTION 1 - ACCESS AND ACCOUNT
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You warrant that all the information you provide to us is correct, current and complete and that you have all rights necessary to provide this information. You are solely responsible for maintaining the security of your account credentials and your account activity and may not transfer, assign, or license your account to any other person.
All personal information that We may use will be collected, processed, and held in accordance with the provisions of the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
SECTION 2 - OUR PRODUCTS
We make every effort to provide an accurate representation of our products and services in our online stores. However, images are displayed for guidance purposes only and may not represent an accurate copy of the final product. All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit quantities of products that we offer to any person.
All products are sold subject to availability. If a product ordered is unavailable for whatever reason, we will contact you. If a suitable alternative cannot be arranged, a full refund will be provided.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason at its discretion and your order is not accepted until we confirm acceptance. We must receive and process your payment before your order is accepted. Review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted. If we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email provided at the time the order was made. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. We are under no obligation to fulfil your order, particularly if there is an error in the system that causes the wrong price to be displayed. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Prices include VAT at the applicable UK rate, but do not include postage, shipping, or other charges.
Prices posted in our online stores may be different from prices offered in physical stores and we may offer promotions on our Services that may affect pricing and are governed by separate terms and conditions.
You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are authorized to use such payment method for the purchase, (iii) charges incurred by you will be honoured by your bank/credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and applicable taxes.
SECTION 5 - SHIPPING AND DELIVERY
We are not liable for shipping and delivery delays. All delivery times are provided for guidance only and are not guaranteed. Once we transfer products to the carrier, title and risk of loss passes to you.
SECTION 6 – RETURNS, REFUNDS & EXCHANGES
We have a 30-day return policy for most items purchased online and in store. After this period, no refunds or exchanges are provided.
Eligibility for Refunds & Exchanges
To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You will also need the receipt or proof of purchase.
Exceptions / non-returnable items
We are unable to refund or exchange:

Personalised items, such as names, years or departments added to clothing

Items that have been damaged by attempted repairs

If you no longer want an item (for example because it’s the wrong size or colour) unless you bought it without seeing it

Underwear - for hygiene reasons, we are unable to accept returns of underwear if the original packing seal has been broken.

Sale items or gift cards
Damages and issues
Please inspect your order upon receipt and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can rectify any issues.
Online purchases
Notwithstanding the above, for online purchases within the UK and EU you have the right to cancel or return your order within 14 days of delivery for whatever reason; as above, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase. You then have another 14 days to return the goods once you have informed us of your wish to cancel or return your order. We will refund you within 14 days of receiving the goods back.
How to process a refund or exchange
For faulty and incorrect items, if your return is accepted:

To request a refund, contact us first at TheLocker@soton.ac.uk. Items sent back to us without first requesting a return will not be accepted. Returns are not available for posting from outside the UK.

We will send you a return shipping label and instructions on returning your item.

Once your return is received and inspected, we will notify you by email. If approved, any refunds will be processed back to the original payment method within 14 working days and replacements within the same timescales.

Shipping costs from your original order are non-refundable, you will only be refunded for the products purchased.

Refunds may take some time to show on your statement depending on the processing speed of your bank or credit card company. Please allow over 14 business days once we have approved your refund to contact us.
For exchanges:

To request an exchange, contact us first at TheLocker@soton.ac.uk. Exchanges are not available for posting outside the UK.

Securely pack the item with your original order number and send it to us at:
The Locker – Returns, University of Southampton Students’ Union,
Building 42, University Road, Southampton SO17 1BJ.

Retain proof of posting and relevant insurance. We are not responsible for items until we have received them.

Customers are responsible for return shipping costs for exchanges.

Once your return is received and inspected, we will notify you by email and if approved, replacement items will be sent within 7 working days.
SECTION 7 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, displays and images, are owned by us and are protected by copyright and other intellectual property laws. These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, publicly display, or transmit any of the material on the Services without our prior written consent. Nothing in these Terms shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of The Locker. Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans are the trademarks of their respective owners.
SECTION 8 - RELATIONSHIP WITH SHOPIFY
The Locker is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with The Locker. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and The Locker, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with The Locker.
SECTION 9 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may be subject to Shopify’s Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read and agree to these privacy policies. As the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services may be transferred to and processed in countries outside the United Kingdom, including Canada and the United States. Where such transfers occur, we take steps to ensure they are lawful under UK data protection law, including appropriate safeguards where necessary.
SECTION 10 - LIMITATION OF LIABILITY
Subject to the above, our total liability to you in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise arising in connection with the performance or contemplated performance of the Contract shall not exceed the total price of the goods and postage costs.
We will not be liable to the Buyer for loss of profit, data, business or depletion of goodwill nor for any indirect or consequential liability, loss or damage which arises out of or in connection with the Contract.
